1. Scope and Parties
These Terms and Conditions (AGB) govern all purchases made by private consumers (B2C) from our online store. They apply to all orders and form a contract between you (“Customer”) and us, the seller, based in Germany. All contracts and communications are conducted in English. By placing an order, you agree to these Terms.

2. Offer and Contract Formation
Our product listings constitute an offer. The contract is concluded when we confirm your order by email. You will receive a summary of the order and these Terms. We may refuse or cancel orders at our discretion (e.g., if the item is out of stock). Prices and availability are subject to change until order confirmation.

3. Pricing, Payment, and Taxes
All prices on the website are in [Currency] and include German VAT, where applicable. For customers outside the EU, VAT may be zero-rated (exports), but you may incur local customs duties or taxes, which are your responsibility. Shipping costs are extra and will be shown at checkout. We accept payment by credit card, PayPal, and other methods indicated at checkout. Payment is due in full at the time of placing the order.

4. Shipping and Delivery
We ship worldwide via third-party carriers. Shipping fees and estimated delivery times depend on the destination and selected shipping method. Risk of shipment passes to you once the goods are delivered. In the case of undeliverable packages, we may deduct reasonable costs. You must inspect the delivery immediately and inform us of any obvious defects or damages.

5. Right of Withdrawal (Cancellation)
For most products, you have a 14-day right to withdraw from the contract without giving any reason. The withdrawal period begins the day after you receive the goods. To exercise this right, you must notify us in writing (e.g., email) within 14 days. You may use our Withdrawal Form (available on request), but it is not mandatory. After notifying us, you must return the goods within 14 days, and the return shipping costs are at your expense. We will refund all payments (including standard delivery costs) without undue delay and within 14 days after receiving your withdrawal, using the same payment method.

6. Exclusion of Withdrawal (Hygiene Products)
Hand grippers are hygiene-related fitness products. In accordance with EU law and German Civil Code §312g(2) no. 3, the right of withdrawal does not apply to sealed products that cannot be returned for health or hygiene reasons once opened. This means unopened and unused hand grippers may be returned within the withdrawal period, but once the seal or original packaging has been opened, you cannot return the product. This exclusion also applies to any other personal care or hygiene products we may sell in the future.

7. Return Procedure
Before returning any goods, you must contact us to obtain return instructions or an RMA (Return Merchandise Authorization). Unauthorized returns may be rejected. The goods must be returned in their original condition and packaging. Return shipping costs are at your expense, except in case of defective or incorrect goods. We recommend using a trackable shipping service as the risk is on you until we receive the package. We are not responsible for returns lost or damaged in transit. Returned items must be unused, in resalable condition, and include all original accessories. If returned goods are damaged or incomplete, we reserve the right to refuse the return or claim damages.

8. Refunds
Once we receive and inspect your returned goods and confirm they are in original condition, we will process the refund. Refunds will be made to the original payment method. Please allow up to 14 days for the refund to be issued. We will notify you when the refund has been processed. If the goods are not returned or are unsuitable for resale (beyond reasonable checking), we may cancel the withdrawal and not issue a refund.

9. Warranty and Liability for Defects
We provide the statutory warranty for defective goods. You have the legal right to request a remedy if items are defective or not as described. Please notify us promptly of any defect by email or via our contact form. If the product is defective, we will either repair or replace it, or provide a price reduction or full refund, in accordance with statutory rules. You must return defective items to us (shipping costs will be covered by us in this case). Our liability for defects is subject to the provisions of §§ 433ff. BGB. We are only liable for intent and gross negligence. For minor negligence, liability is excluded except for breaches of fundamental contractual obligations (cardinal duties), in which case liability is limited to foreseeable, contract-typical damages.

10. Limitation of Liability
To the extent permitted by law, we disclaim all liability for damage arising from misuse of products, modification of products, failure to follow instructions, or normal wear and tear. We are not liable for any external links to third-party sites or their content. For shipping delays or force majeure, our liability is limited to refunding the shipping cost, unless the delay is caused by our gross negligence.

11. Ownership of Goods
Until you have fully paid the purchase price, the goods remain our property (retention of title). You may not pledge or assign the goods as collateral. Until ownership transfers, you must handle the goods with care and maintain insurance. Once the price is paid in full, ownership passes to you.

12. Contract Language and Amendments
The contractual terms are provided in English. We may revise these Terms and Conditions from time to time; the current version published on our website will always apply. Revisions do not apply retroactively to contracts already concluded. In case of updates, we will post the date of the last revision at the top of this page.

13. Governing Law and Jurisdiction
These Terms and the contract are governed by German law (without reference to conflict-of-law rules) and the EU Consumer Rights Directive. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply. If you reside in Germany, your statutory consumer rights also apply. If you reside outside Germany, mandatory rules of your home country remain unaffected. Any disputes arising from these Terms shall be brought before the competent court in Hamburg, Germany, unless you choose your local court (as a consumer).

14. Severability
If any provision of these Terms is invalid or unenforceable, the remaining provisions will remain in full force. The invalid provision shall be replaced by a legally valid one that most closely matches its economic intent.
